FishEye works in some positions, not in others. 5 Months, 2 Weeks ago

The fish eye menu for me works well at the very bottom of the page (position footer). Then when I ad it any other position (the one I want is user3 over the pill menu)..It doesnt work (all the icons are stacked and the red "power" icon is on top.
I guessed it was mootools, and so I disabled that and the icons are listed (small) but perfectly. they just dont zoom or anything.
How come the fisheye works below the footer but not in the user 3 position?
